You got locked up this morning. You have an important appointment tomorrow. And you are wondering if your sciatica truly justifies sick leave — and what it entails in practical terms.
Direct answers, without the administrative jargon.
1. Does sciatica justify sick leave?
Yes — if the pain prevents you from performing your professional activities normally. Your primary care physician is the only one who can evaluate this. They take into account the intensity of the pain, the nature of your job, and your general condition.
Sick leave is clearly justified if:
- Pain is greater than 7/10, preventing any concentration or mobility
- Job involves lifting heavy loads, demanding postures, or prolonged driving
- Acute flare-up within the first 48 hours
Sick leave is likely avoidable if:
- Sedentary job that can be adapted (remote work possible)
- Pain is between 4 and 6/10, manageable with painkillers and support
- Visible improvement within 48 to 72 hours
2. Average duration of sciatica sick leave
- Acute flare-up without complications: 3 to 10 days
- Moderate sciatica with a herniated disc: 2 to 6 weeks
- Severe or recurring sciatica: up to 3 months
3. Compensation: what you actually receive
Private sector employees
Waiting period: 3 days not covered by the Social Security (Sécu), unless your collective agreement is more favorable. From the 4th day on: daily allowances = 50% of the base daily wage (capped). Most collective agreements provide for supplementary salary maintenance by the employer.
Civil servants
Standard sick leave with no waiting period. Full salary is maintained for up to 3 months, then half-salary follows.
Freelancers and sole traders
3-day waiting period for artisans and merchants. Lower compensation, subject to minimum contributions. Check your specific scheme.
4. Step-by-step procedures

- Consult your primary care physician (or the on-duty doctor on weekends)
- The doctor issues a medical leave certificate in 3 parts
- Part 1: keep for yourself (confidential, contains medical details)
- Parts 2 and 3: to be sent to the CPAM within 48 hours
- Part 3: to be handed to your employer within 48 hours
- Your employer transmits the information for the calculation of benefits
If you miss the 48-hour deadline to send your leave certificate to the CPAM, your daily allowances may be reduced. If the leave starts on a weekend, send it by Monday.
5. Alternatives to complete sick leave
Remote work on medical prescription
Since the Occupational Health Law (2021), the occupational physician can recommend remote work as an adaptation measure. Your primary care physician can also suggest this to your employer.
Therapeutic part-time work
Upon returning after sick leave, this allows for a part-time return while maintaining a portion of the daily allowances. Must be requested from your doctor during the return-to-work medical examination.
Workstation adjustment
The occupational physician may recommend: an ergonomic chair, a sit-stand desk, or a limitation on lifting loads. The employer is legally required to adapt the workstation to the employee's state of health (Article L4121-1 of the Labor Code).
6. Sciatica as an occupational disease
Lumbosciatica can be recognized as an occupational disease (Table no. 98 of the general scheme) if it results from postural constraints specific to your trade: manual handling, vibrations, or sustained postures. This recognition allows for better coverage and higher compensation.
Inquire with the occupational physician or the CPAM.
7. The return: what you need to know
For leaves of more than 30 days, a return-to-work examination with the occupational physician is mandatory within 8 days of returning. It may lead to recommendations for adjustments or a declaration of partial unfitness.
For leaves of less than 30 days, a pre-return examination is possible at your request if you fear difficulties in returning to your position.
🔷 Avoiding sick leave — often possible with the right tools
Worn discreetly at the office, the Soreva Belt combines 45–65°C heat, 660 nm red light, and 6,000 rpm massage. It can allow you to get through a sedentary workday without worsening the flare-up — and help avoid sick leave when the job allows.

Can you be fired during sick leave?
Not due to illness — that is illegal in France. However, an employer may terminate for a different cause (serious misconduct, economic reasons) during the leave period.
Can the employer contest the sick leave?
They can request a medical counter-visit mandated by the employer. If the appointed doctor disputes the leave, the CPAM makes the final decision. The primary care physician remains the ultimate decision-maker.
Can you work during sick leave?
No for other paid activities, unless expressly authorized by a doctor as part of a therapeutic part-time arrangement. Going out is allowed according to the hours specified on the sick leave certificate.
Is sciatica 100% covered?
Not systematically. 100% coverage (exemption from the co-payment) is possible in the case of a long-term condition (ALD) — which applies to severe chronic sciatica. Ask your doctor about this if you have been suffering for more than 6 months.
